Keep in mind that before someone could be prosecuted for being over the GVWR, first they will have to weigh the loaded vehicle. If they are not weighing the vehicle the citation is for something else.
In some cases the LEOs have a sneaky way around citing for specific offenses. Some laws start out, "If in the opinion of the officer..." In my opinion those laws really stink and should be unconstitutional. How the heck can you mount a defense against an officer's opinion?
So if a law says, "If in the opinion of the officer a vehicle is overloaded and/or unsafe". Guess what, you have no defense, you are guilty because his/her opinion says you are!
