Seems to me that none of these laws apply to anyone except commercial drivers. I'm with another prior poster, that GVWR's are not legally binding for non-commercial drivers.
And why are we even discussing this here? WHO CARES. The OP's trailer is under-engineered and has a false GVWR. Its not about what the law says regarding weights right now, he cant even tow the darn thing!!!! The poor guy has been pulled thru the ringer by this trailer company and the dealer.
IMO. Get an attorney ASAP and do what he says. I think its obvious you should document what the frame specialist found in writing and pictures. Leave the trailer with the dealer and don't touch it until this is resolved or the trailer replaced. And finally, be prepared that you will NOT have the option to decide who fixes it, or how they fix it. You can voice your opinion, but the trailer company who issued the warranty makes the call.
