I was under the impression that it was supposed to be attached to something other than any part of the hitch. I have a loop that is attached to my bumper up underneath and I use a spring clip to attach it there. I have it ran through two or three links on my chain to keep it up and out of the way. Given it's name, I don't think it's supposed to actuate the brakes unless the trailer has actually become detached from the tow vehicle, even under the worst case scenario of an unlikely hitch failure.
