Easy to say now but an accident caused by a condition that is obviously not safe and not at least POLITELY mentioning is negligent IMHO.
How about the person over factory GCWR, but under an equal rig with a bigger motor, lower gears.......All the taller gears mean in a literal moving performance factor! ie starting on a say 15% grade, vs 12%. One is in spec, the other not! Or back when I first bought a new rig, GM gave folks an additional 25% gcw when speeds under 25 MPH were done!
The tires on my bobcat, good to 4500 lbs total weight, BUT, fine print, when used at speed ABOVE 25 mph, then total is ~3000 lbs. On par with a typical LT style tire of the same size.
We can ALL point out places where some things are rated for X in such and such situation, But in another, it would not meet the spec for THAT situation!
