New Canada Border regs.

I posted this in the snowbird forum but it affects many Canadian travelers to Mexico. Presently Canadians cannot drive from Mexico to the USA. But now even if you fly returning to Canada could be a problem. I imagine that right now there must be some Canadian RV'rs that are stuck in Mexico. The above regulation takes affect on Jan.7 and Canada is looking into applying the rule to land borders. Covid strikes again.

As others have stated it is up to the agent when you reach the border. Although crossing is prohibited if you can provide a reason he can allow you to pass. Maybe a leter from a US or Canadian Dr. stating you have an appointment for a serious condition. Or some other explanation that might appeal to his softer side. If I decide to return to Mexico I will have my truck shipped from Sonora to Tucson and I will fly. I now think that the border will not open until late fall.

Here is the response I got about 8 hours later. Still not much help. Remember the question was regarding a Canadian citizen who lives part time in Mexico, driving a Mexico plated vehicle who wants to return home to Canada.

Thank you for contacting the U.S. Customs and Border Protection (CBP) Information Center.

In order to limit the further spread of the Novel Coronavirus Disease (COVID-19), on March 21, 2020, the United States reached an agreement with both Canada and Mexico to limit all non-essential travel across land borders. U.S. citizens, lawful permanent residents, and certain other travelers are exempt from this action when entering the United States.

Notification of Temporary Travel Restrictions Applicable to Land Ports of Entry and Ferries Service Between the United States, Canada, and Mexico:

Canada: https://www.federalregister.gov/documents/2020/10/22/2020-23394/notification-of-temporary-travel-restrictions-applicable-to-land-ports-of-entry-and-ferries-service

Mexico: https://www.federalregister.gov/documents/2020/10/22/2020-23392/notification-of-temporary-travel-restrictions-applicable-to-land-ports-of-entry-and-ferries-service

These measures were originally implemented on March 21, 2020 and have been extended by 30 day increments throughout the course of the COVID-19 pandemic. The updates for these measures will be available here: https://www.dhs.gov/news/2020/10/19/fact-sheet-dhs-measures-border-limit-further-spread-coronavirus.

The following travel does not fall within the definition of โ€œessential travelโ€:

โ€ข Individuals traveling for tourism purposes, such as sightseeing, recreation, gambling, or attending cultural events in the United States.

โ€œEssential travelโ€ includes, but is not limited to:

โ€ข U.S. citizens and lawful permanent residents returning to the United States.
โ€ข Individuals traveling for medical purposes (e.g., to receive medical treatment in the United States).
โ€ข Individuals traveling to attend educational institutions.
โ€ข Individuals traveling to work in the United States (e.g., individuals working in the agriculture industry who must travel between the United States and Canada or Mexico in furtherance of such work).
โ€ข Individuals traveling for emergency response and public health purposes (e.g., government officials or emergency responders entering the United States to support federal, state, local, tribal, or territorial government efforts to respond to COVID-19 or other emergencies).
โ€ข Individuals engaged in lawful cross-border trade (e.g., truck drivers supporting the movement of cargo between the United States, Canada, and Mexico).
โ€ข Individuals engaged in official government travel or diplomatic travel.
โ€ข Individuals engaged in military-related travel or operations.

This action does not apply to air, freight rail, or sea travel at this time, but does apply to commuter rail and ferry travel.

CBP officers at ports of entry make the determination of whether a traveler is admissible to the United States, taking into account the totality of the travelerโ€™s circumstances.

Travelers should contact the port they plan on traveling through, if they have a case-specific question. Ports of entry: https://www.cbp.gov/contact/ports

Boy, that's not much help. I posted with CBP on January 3, and have yet to receive a reply.

I received my reply from CBP:"The CBP officers at the border will decide if you can enter the US by land to transit to Canada." They included the list of what is essential. I will call the Mariposa crossing when I will be in Mexico.

This is where you can ask questions about border crossings. I posted a question but probably the reply will be to contact the actual crossing office. I thought it might be worth a try.

As I stated on my earlier post. Do your own due diligence . The responses that I got from the agents mean nothing if they don't like your face. Border open or not , it's the agent you are dealing with at the time of crossing who determines if you get through or not.

I phoned 3 border crossings this morning at approx. 10:00 and here is what they told me.

Concerning Canadians crossing into the USA from Mexico to get home.

Lukeville- No

Nogales, Mariposa- Yes. I phoned a few times and the answer was always -- "Yes"

Eagle Pass- No

So there you go.....If I were down there, I would phone Nogales and try them.

Good luck to you all.

Sorry but the us border is closed to Canadians at both the southern and northern ends. The US has published this info. There may have been one or 2 incidents of someone being allowed. The US statement could be clearer. Canada is very clear. At land borders US tourists are not allowed with one exception for those going to Alaska. One couple stayed in Canada and went to Banff. They paid a fine of around $5000.
