Myvehicle broke down and I called roadside assistance, who sent a tow truck driver to pick up my car and take it to a mechanic shop. Upon receiving a call the next day, I get the news from the mechanic shop that my car had been broken into, to call and meet up with the local police at the shop. The theft involved both the in dash upgrade radio I'd just installed and the original OEM radio in the trunk as well as cash I had hidden for the mechanic shop . The shop claimed that because the tow truck driver didn't lock the doors to my car, "as is the policy" that they are who need to file a claim for my damages. Well it's slightly to very confusing, and you guessed it. It's time to speak to an insurance expert attorney because I do not want to file under my car or home insurance policy. I shouldn't have to AND do not want to chance my insurance rates to go up... up. Do I take it myself to small claims court which apparently I have no choice or let my insurance company know and they in turn subrogate the damages to whoever is at fault..?
