Technically, it's not a hit and run because the other vehicle was not hit and, thus, no damage. Although the cause of the accident, he was not involved in it - it's a one vehicle accident. Should he have stopped? Absolutely. Was he obligated to by law? Unfortunately, no - not here in Ontario anyway. If there was contact in any way between the vehicles, then the answer would be yes.
