I am sure I am opening myself up once more to being ostracized by the usuals on this forum. I try to help those who may need a little help once in a while but then the usuals come in with negativity and whatnot. But here it is again. Some info I found about the laws. Lots of other laws etc on other threads about this. You may know lots more than I do. I know nothing. Nor am I suggesting that anyone print these laws out to wave in the face of the authorities at the border. I am merely providing a way to find laws which may or may not pertain or be of interest to anyone on this forum. If you are not interested why bother to comment?

THIS IS NOT THIRD PERSON – IT IS FIRST PERSON LAWS FROM THE MEXICAN GOVERNMENT.

At least part of the problem is there are too many laws and the wording of the laws can vary and be in conflict with the wording of other laws. So the people at the border may find laws and wording open to interpretation. Below are some of the laws as well as emails I received from agencies of the Mexican government. These are not my words. They are direct copy and paste of the laws along with the web addresses where these laws can be found. NOT MY WORDS.
This is where this manual for Temporary Importation of Vehicles can be found. It is a 69 page manual with the applicable wording found on page 22. (translation of all below by Google)

Restricciones de los vehiculos que pueden importarse temporalmente
Restrictions on vehicles that may be temporarily imported:
Vehiculos que tengan una capacidad de carga maxima de hasta tres y media toneladas de peso (3 y ½ toneladas que equivalen a 7716.17 libras)
Vehicles having a maximum load capacity of up to three and a half tonnes of weight (3 and 1/2 tonnes equivalent to 7716.17 pounds).
But of course there is always another law with other wording. Somehow someone seems to have changed the wording from “capacidad de carge” to GVWR – lost in translation?........

Under REGULATIONS scrolling down to 578 gets to this – which may or may not mean anything……….. seems they use the word “carga” to means “Load whose weight added to the vehicle weight” but I have no idea. Far too many laws. I have no idea what it might mean. To me “carga” is the weight loaded into the bed of the pickup.
Also this – “The maximum weight of the load that a vehicle can transport in safety conditions and for which it was designed by the manufacturer or rebuilder.” Here they say this is what the manufacturer says the vehicle is capable of – “capacity”).
1. Vehicles related to weight:
It is important to note that Article 158 of the Regulations of the Customs Layout specifies that the restriction on the maximum capacity of three and a half tons of vehicles, is for foreigners who wish to carry out the temporary importation procedure of their vehicle, noting that this legal provision does not apply to Mexicans residing abroad, as well as to those who prove to be working abroad for a year or more.
“Sólo se podrá efectuar la importación temporal de vehículos que tengan una capacidad máxima (gross vehicle weight rating) de hasta tres y media toneladas de peso (3.5 toneladas que equivalen a 7716.17 libras), de acuerdo a la capacidad de carga, conforme a las especificaciones técnicas del fabricante.”
"Temporary importation of vehicles with a gross vehicle weight rating of up to three and a half tonnes of weight (3,5 tonnes equivalent to 7716.17 pounds) may only be carried out according to the load capacity, in accordance with the manufacturer's technical specifications. "
En razón de lo anterior, en los casos en que el importador presente un CERTIFICADO DE REGISTRO VEHICULAR con una clasificación de peso bruto del vehículo (gross vehicle weight rating) de más de las 7716.17 libras, el importador deberá demostrar o evidenciar que la puerta lateral del vehículo ostente la placa de características con el número de identificación (VIN) y el peso máximo autorizado, a fin de confirmar que se trata de un peso menor.
For this reason, in cases where the importer presents a VEHICLE REGISTRY CERTIFICATE with a gross vehicle weight rating of more than 7716.17 pounds, the importer must demonstrate or evidence that the side door of the vehicle bear the nameplate with the identification number (VIN) and the maximum authorized weight, in order to confirm that it is a smaller weight.

And here once again are copies of a couple emails I received from SAT about weight. This refers to the “tres y media toneladas de peso” ( 7,716 lb) “capacidad de carga” misinterpretation some border authorities have been denying access because of. The English words and translation are from the authorities in Mexico - not one word in English below comes from me - it all comes from them. No matter whether it is a pickup truck or whatever - these are the rules as clearly explained to me by the authorities.
Here are the exact words I received by email from SAT with their own translation of the Spanish to English. I assume this is from the person who sent me the email and their personal interpretation of the law. This does not seem to be what is being used at the border.

El termino capacidad máxima de tres y media toneladas de peso hace referencia a la capacidad de peso de carga, esto es, a la capacidad de peso de los pasajeros, equipaje y paquetería, sin contemplar el peso del vehículo, el cual únicamente se toma en cuenta cuando se habla de peso vehicular o de peso bruto vehicular

I. The documentation proving their status of stay, according to the applicable legislation;
II. The documentation proving the legal ownership or possession of the vehicle in accordance with the following:
a) Title of ownership or registration of valid plates that accredit them as owners of the vehicle, issued by competent authority of the foreign country.
The interested party may carry out the corresponding procedure, even if the document proving ownership of the same, is in the name of his spouse, ascendants or descendants;
b) Lease in the name of the importer and the letter from the lessor authorizing the use of the vehicle abroad;
(c) Credit agreement in the name of the importer, or
d) Document proving the employment relationship of the importer with the company that owns the vehicle and the document proving the ownership of the vehicle by the company;
Ill. The guarantee determined by the SAT through Rules;
lV. Declaration under protest of truth, in which the interested party undertakes to return the vehicle in question within the authorized period and not to perform acts or omissions that constitute infractions or crimes for the improper use or destination of the same;
V. To make the corresponding payment by means of procedure for the temporary importation of vehicles, and
SAW. Comply with the other requirements established by the SAT through Rules.
