You missed the point entirely. I didn't say they couldn't tell the difference. Okay, I did, but I left out the context: If someone had whipped that out of the glovebox and pointed it at you during a traffic stop, how would you have reacted (remember you have about a quarter of a second to decide what it is and whether it will harm you)?
That's not what happened here, but that's why there are rules. The guy probably had an attitude and the cop's ego couldn't handle it. It happens. I agree it's a waste of everyone's time and money to prosecute. A sensible judge would toss it out (but there aren't a lot of those either).
Somehow people that comply with the law and show some respect never wind up on the news, in cuffs or dead.
