If you have spent over 4 months per year (approx) for the last three years, you MUST fill out 8840. Doesn't mean you will be subject to IRS but you MUST prove a closer connection to another country to avoid IRS. And the IRS doesn't come after you for income earned in USA, it's WORLDWIDE income (how they get away with that is beyond me but that's how it is).
I fill out 8840 AND make sure I never spend over 6 months in a 12 month period in USA.
