Funny you should bust the OP's bubble by implying he might be violating the law in certain states. Hot Spots and unsecured WiFi are available to anyone who wants to use it. If the owner of the WiFi was worried about people using their service they would make the connection password protected.
Considering WiFi uses radio waves that can be received by anyone with a smart phone or computer, prosecution of a criminal case involving the use of an open WiFi connection would not be a high priority crime in most if not all police departments.
