The angle of the photo above makes it difficult to be sure, but it looks like the locking lever is in the notch. But there is a lock hasp between the hitch head and the latch. That hasp should be through the hitch head and the lever. That prevents the lever from disengaging by accident or malice.
A lock isn't necessary at all, but if you use one, you don't want it positioned as shown in that pic.
For example, I use a clip like this. I have also shortened my release handle, as others mentioned.
