The sad thing is, some insurance companies will charge this collision to the driver of the truck/5th wheel. I've had this happen to me on a freeway service road when a car that was beside me tried to change lanes right into my driver's door. I was HARD on the brakes and steering to the right to try to stay away from him and wound up curbing my right front wheel to miss him. No real damage other than some severe curb rash on an aluminum wheel, but I chased the guy down and got his insurance information.
To my surprise, the first thing his/my insurance companies asked was, "So, did he hit you?" When I responded "no", then it became my responsibility - there was no collision between the vehicles, so in their sight I just ran my vehicle into a curb for no reason. If the oncoming car didn't actually hit the truck/5th wheel before they took to the ditch, I could easily see them being caught in this same Catch 22 situation.
