Nah, you're not missing anything. This is just a bunch of nervous nellies doing what they do.
If the jaws/pin fail, the cable gets pulled.
If the whole hitch pulls out of the truck, I'm pretty sure a hitch dangling from that cable will also pull it.
A better question might be, has anyone actually gotten a citation for attaching his e-brake cable to the hitch? Maybe so, but that would be the unluckiest bugger you've never met.
