Nope, can't "high hitch" a B&W Companion. You can put the pin on top of the jaws but that isn't a high hitch, that's a non-hitch. If the jaws close and the handle snaps back, you're locked in. If both of those two things don't happen, you're not hitched, and yes you could drop the trailer if you pull forward with the legs up.
