I asked my neighbor about this before he retired. He was in charge of our local CHP Commercial units (the guys in the trucks & camper shells). He told me that the license requirement is based on GVWR of the trailer, not the actual weight. So even if you're unloaded and under 10,000, if the sticker shows 10,001, then you're out of class.
He said that they carry scales to see if your trailer is overloaded (too much weight for the tires and/or axles). So the comment earlier in this thread about the license requirement being based on your tire ratings is incorrect.
Your best bet is to read the DMV handbook and get the facts for yourself.
