I'm not seeing any damage to the hitch head, maybe I am missing something in the dark photos. If you are referring to the offset jaws in the photo looking down on the head, that is normal. The jaws are free to pivot like that when there is no king pin inserted.
Hate to say it, but I think your tow driver was correct about not being hitched properly. That hitch head is unscathed.
