It seems while hitching up, one would have to start with the tailgate down and once the pin box clears the tailgate then to raise the tailgate. That may be the norm but is something I have not had to do.
My new KZ has about 4-6" less clearance with the gate down, than my old Komfort did, when aligned straight; just enough that I can squeeze by, if necessary, though. Were I to need to come at an angle, I'd have to have someone close the gate as I backed up. Now, if I have my v-gate installed... :B
