ยง 571.120 Tire selection and rims and motor home/recreation vehicle trailer load carrying capacity information for motor vehicles with a GVWR of more than 4,536 kilograms (10,000 pounds).

S10. Each motor home and recreation vehicle (RV) trailer must meet the applicable requirements in S10.
S10.1 On motor homes, the sum of the gross axle weight ratings (GAWR) of all axles on the vehicle must not be less than the gross vehicle weight rating (GVWR).
S10.2 On RV trailers, the sum of the GAWRs of all axles on the vehicle plus the vehicle manufacturer's recommended tongue weight must not be less than the GVWR. If tongue weight is specified as a range, the minimum value must be used.

Above regs are new as of 6/15/'08.
In late '08 or early '09 we had a member in the TH forum with the same issue with undersized axles. His unit was still under warranty.
He contacted his dealer and the RV maker with the new 571.120 S10 regs. After a couple of weeks the manufacturer sent a new set of 7k axles to the dealer who installed them free of charge.
The old regs allowed the RV manufacure to not use hitch weight as part of the trailers GVWR. Some RV makers are still doing so and some are making the units GVWR = to the GAWRs plus the hitch weight.
