Short answer: Nobody knows. :)
My SmartTrailer was like that only it had 2 swivel wheels. You can't rely on the answer you get from the DMV of a particular state because they don't really know either. And you may get one answer from the DMV but the LEO who stops you may feel differently, and his opinion is the one that matters at that moment. :)
I always went by the maxim: "It's easier to request forgiveness than permission". It worked for me for three years and we traveled through, and in, several states that don't allow double towing, and were never stopped.
