Just one problem. You're quoting from Chapter 522 of the Texas Transportation Code. That's for commercial driver licenses, which might be fine if that's they type of license you hold. Chapter 522 specifically exempts RVs driven for personal use from requiring a commercial license.
For those without a commercial driver license, Chapter 521 covers non-commercial driver licenses and therefore would apply to personally-driven RVs. Chapter 521, Subchapter D states:

(b) For the purposes of Subsection (a)(3), seating capacity is computed in accordance with Section 502.253, except that the operator's seat is included in the computation.
