assigning fault on accident

Last summer I was driving my wife's car and we were rear ended. The other driver admitted fault and her insurance company is taking care of medical and damage costs.
We were amazed when we discovered that National General has assigned the blame to us as they do not READ police accident reports and just assign blame to their insured even if there is no claim they are involved with. It is up to the insured to PROVE they were not at fault. This is some way to run an insurance company. Marcus, maybe I might have to look into other insurance companies and their rates

  • Just an update. After posting here I was contacted by a rep from National General. They offered to contact the other parties ins co to verify whose fault it was, reversed my premium increase and issued a refund for previous over charges
  • Not sure if the fault lies with the insurance company or the state in which the accident took place. Some states require that fault be divided between the participants, based on evidence such as the police report, witness reports, etc. Others don't.
  • I'd be switching companies real quick. Your insurance company just wants your premium money and will not back you up when you need them the most. It's not up to you to prove your innocence but instead up to the company to prove you are at fault. Dump 'em and tell everyone you can not to do business with National General.
  • SOP with my insurance company, too. I had a similar claim, and had to provide them with verifiable proofs that it wasn't my fault.

    Educational, really- turns out that when we make a claim, that's what they investigate- the CLAIM. Since I "claimed" that I wasn't at fault, I had to point them toward the proof. Gave them the necessary proofs and that was that.
  • That's not right. Every state licenses insurance companies to do business in their state. I don't know about Ohio, but Oregon's was called the Insurance Commissioner when I worked there. If the insurance company doesn't budge and STILL says you're at fault, then I'd be writing the Commissioner. That on your record will hurt you in the future.....and is just plain not right. The insurance commissioners investigate. Let me tell you, the ins. companies do NOT want the commissioners to EVER come to their office or investigate. It used to be we would go thru records of complaints (before computers) and the commissioner would investigate the company when there were too many complaints. And many times, the companies reverse their decisions. Good luck!
