Damage claim with Good Sams

Our experience with Good Sams has been less then satisfactory during our road trip for several reasons. We needed a tow and the tow truck pulled our truck and the truck got stuck on the pin and dragged the camper a bit. This bent the lift leg and our lift leg won't allow the drop down leg to move up and down. We put in a damage claim and Good Sams said they will call us back after the holiday weekend (July 4th). However, Good Sams never got back to us, but the tow company called and left a message. What is normal procedure for a damage claim? I'm not looking to get involved with the tow truck company, but believe Good Sams should be dealing with this? I just want the camper repaired so we can move on with our family vacation. I did trying calling Good Sams, but their system is down per the phone recording for customer service.

  • I totally agree with Rollinhome... It's Good Sam's responsibility.

    PS.. by the way, the company's name is "Good Sam"... not "Good Sams". Picky, picky, picky... I know.
  • The contractor is responsible for it's sub contractors. You have no agreement with the tow company. Your agreement/contract is with GS. GS has a contract with the tow company and GS should deal with the tow company. You should go through the business you have a contract with. Yes the sub contractor may indemnify GS but that is their agreement you are not a party to that sub contract. GS is your primary contract provider and is the one you should deal with. What happens between GS and tow company is not your concern. That's the way it has worked for the 40 years I have been contracting. Basically GS pays you and tow pays GS and in civil or criminal cases holds harmless and defends GS against their (the tow company) misdeeds

  • While you may want GS to deal with this, I really see it as the tow company's problem. In my business, I was required to indemnify the person who referred the customer to me. In other words, if I screwed up, I or my insurance paid. I believe the same applies here. You may have to file with your insurance company and then have them go after the tow company's insurance which they may or may not do depending on the size of their payout.
  • Spoke to Good Sams and they said we should hear back from them shortly. I expressed my desire not to get involved with the tow company. I want Good Sams to deal with the situation. I will keep everyone posted on how this pans out.

    Why should GS handle it?
    When a tow truck damaged my car, they asked me where I wanted to take it. I took it there and they just paid the bill.
