I guess head gaskets are considered "regular wear and tear" items in some policies, although "pre-existing condition" does sound a little far fetched. Seems odd, but there are always two sides to every story. I'd like to know why they denied the claim, on what basis specifically they decided it was pre-existing, and was there a specific written caveat in the policy regarding head gaskets and other replaceable parts considered failing due to wear and tear, before drawing any final conclusions.
