Under RIVA guidelines, any window that is in an area where carbon dioxide or in your case carbon monoxide is emitted, cannot be an opening window because of the chance of noxiuos gasses entering the unit. I have the same scenario on my unit, but on the side. My HWH is under the window over the kitchen sink and it's non-opening. When I was at the factory I asked about replacing it with an opening window (radius torque slider) and was told, 'we can sell you a slider window but you have to install it yourself as we cannot. I decided not to.
They aren't that hard to replace, you pull the inner screws out of the frame, remove the inner frame and then take a putty knife and separate the outer window from the body carefully breaking the butyl tape bond and replacement is just the opposite with new sealant tape but I understand the issue with asphysiation so I passed.
