Seatbelt laws for Motor homes in Pennsylvania

What are the laws concerning passengers riding in back of Class A Motor Homes while in motion.

  • OK, one more time. The front 2 seats in your MH are in a "VEHICLE" so all applicable state laws regarding seat belt use apply, kids and/or adults while using those seats. Behind that is a house. If you don't have to wear a seat belt at your dining room table at your stix and bricks house, none is required by law. There are no Federal Motor Vehicle Safety Standards that apply to that part of a MH, so no law can be enforced requiring belts back there. The question then becomes "Should I Require It In My MH?" And that's the only point. Some manufacturers put belts in and do a fair job, but others put them in and I wouldn't tie a Chihuahua Dog to them. Do a search and you'll find a great number of comments on this subject. The choice is yours, there just isn't any LAW that applies. (I was a Safety Engineer for as long as they were certified and set up and trained the cops, EMS and others in Child Passenger Safety programs)

    "Seat Belt Laws Pennsylvania Title 75, the Pennsylvania Vehicle Code, Section 4581

    Pennsylvania Title 75, the Pennsylvania Vehicle Code, Section 4581, requires that any person who is operating a passenger car, class I truck, class II truck, classic motor vehicle, antique motor vehicle or motor home and who transports a child under 4 years of age anywhere in the motor vehicle, including the cargo area, shall fasten such child securely in a child passenger restraint system. This subsection shall apply to all persons while they are operators of motor vehicles where a seating position is available which is equipped with a seat safety belt or other means to secure the systems or where the seating position was originally equipped with seat safety belts.

    Any person who is operating a passenger car, class I truck, class II truck, classic motor vehicle, antique motor vehicle or motor home and who transports a child 4 years of age or older but under 8 years of age anywhere in the motor vehicle, including the cargo area, shall fasten such child securily in a fastened safety seat belt system and in an appropriately fitting child booster seat.

    Except for children under 8 years of age, each driver and front seat occupant of a passenger car, class I truck, class II truck or motor home operated in this Commonwealth shall wear a properly adjusted and fastened safety seatbelt."

    Most that I've seen say very specifically that they are not to be used while under motion and are not a suggestion. The reason for that is to release the manufacturer who installed those belt positions from any liability if the motorhome is involved in a accident.

It's also not uncommon to see a placard/sticker somewhere close suggesting not to use these when in motion because of the absence of seatbelts. Makes good sense to me.:C
  • Most states have it where the persons in the front seats must be wearing seat-belts, but the back seats don't have to....I would guess that the coach of a MH would be considered the back-seats?

    Being that your Map shows that you've been to all but about 6 states, it seems like a strange time to be asking:?:)

    I may be wrong, so you may just want to check with the PA DMV.
