Note I wasn't intending to make a big deal out of being over. I know a lot of people that do it. I know guys pulling 30+' box trailers behind 45' Class A coaches, and they don't typically have problems. Many have said they'd rather have the ticket than have a CDL.
In Texas, most of us are already in trouble. Anything with a GCWR over 35,000 here requires a CDL. Now that Ford, Chevy, and Dodge are rated for over this. I'm going to say it again, in Texas if you have a GCWR over 35,000, regardless of how much weight you have in or behind the truck, you are required to have a CDL.
Where they are getting us is after one of our offroad events when they know there will be a target-rich environment.
