I think that unless the laws of NY State have changed and they don't match what is on their public web sites, you got a bogus ticket. Often the actual statutes don't align perfectly with what is dumbed-down for public consumption and put out on a state web page. The NY State web site, and available synopsis on the interweb show that only front seat occupants must be wearing seat belts. Now, other possible factors might be that there was a front seat open and available, so she should have been in it, or that the second row seat she was in was not facing forward even though she had her seat belt on. Only reading the actual statute, which is probably available on-line, will answer the question for sure.
