The passenger was restrained in the second seat, not the front seat. But the restraint was in use. The statute does not state where you must sit or restrict you from sitting in a back seat.

The point was that the passenger was not sitting in the front seat. She was in the bucket seat behind the passenger seat and probably was not required to have a seat belt as an adult. Seat belt laws
