Lock him up.
Jail time for a 72 year old does nothing for the family and just punishes the taxpayers that have to pay for his incarceration and healthcare. If he was much younger I might agree. He he was drunk, I would agree with jail time.
Once he is found guilty, the officer's family will be compensated from the civil lawsuit. Nothing replaces the officer to his family, not even revenge.
