I spent my entire life in law enforcement, and generally speaking, I would agree with you. However, every case is different and every case should be decided on it's own merits. I don't know enough about this man to say for sure he shouldn't get jail time, but my impression of the case based on what I have read, is it would serve nobody any purpose to put this guy in jail. I'm not happy that he tried to blame everybody but himself back when this happened, but that's not reason to lock him up. He needs to be done driving forever and on probation in case he ignores that order and does drive, but assuming he doesn't violate probation I don't see any value in jail time.
