We originally offered to put up some cash to help the dealership with re-financing the rig or whatever they thought they needed to do just to try to be fair. I am talking about up to $5,000.00.
I thought this was more than fair as it would help them and while we would be out $5,000.00 which would hurt at least we would not have this debt. But the sales manager just kind of laughed at me and said they could not do anything and we had to finish the deal. After that they said they could do something like take it on consignment as long as we did not mind them making money on it again.
Having dealt with similar problems in the past I will say that the dealer cannot force you to do anything, including finishing the deal.
The terms of the agreement that you posted appear as though the deposit in it's entirety is at risk. If the dealer has incurred costs and/or is committed to pursue this you're deposit is likely gone plus any additional legals fees you incur.
