even if my phone is in my briefcase, in the trunk, it's still going to be pinging towers. this smells fishy that any sort of quick check on cell tower activity could be used to assign fault or determine if a cell phone contributed to the crash.
pulling location tracking data (history) is going to require a subpoena, signed by a magistrate or judge (electronic signature even in my little backwater) ... and the cell carrier does not have that data, Apple or Google does, and that's going to take more then 15 minutes to get even if everything is running smoothly.
In Michigan, an officer giving you a print out with the other drivers information on it is a violation of LEIN (law enforcement information network) security protocols. Any information processed by the in car computer, a LEIN terminal, is subject to very strict privacy laws. He could lose his job and the agency could lose its LEIN access for a violation like that. At best, he should facilitate exchanging of information between drivers asking each of them to give your contact info to the other parties. Most States have similar laws, based on federal guidelines.
