Yes, it's much better to be concerned about their rights and allow a criminal to attack you, or worse.
They're only violating state laws, you would be violating Federal Laws by using wasp spray.
That's a real concern to me. :R
In an emergency situation you do what you need to do to protect yourself or others. :W
