I can't see how someone using a jammer could be caught. In the situation the OP mentioned, just turn on the jammer, the drone lands, and no one is the wiser. Mistakes are made when the offended makes contact with the offender and needs to escalate to the next step; using the jammer. Then he's suspicious. Keeping your mouth shut and deploying the jammer is discretion.
BTW, drones are designed to land if they can't receive a valid radio signal to control them.
Another BTW, the purpose of jammer laws;
A jammer could be used to commit crimes. Jamming security cameras, motion detectors, even police drones as well as communications. It's for those reasons fines can go as high as are. I doubt any DA would prosecute or if they did, a judge would sentence a very stiff fine. I could be wrong, but I bet judges don't appreciate drones either.
