You can record a private conversation if you are one of the parties involved in the conversation. Only one of the parties needs to OK it.
Sterling's girlfriend recorded their conversation between them so his permission was not needed.
Yes, No, Maybe. Since Sterling lives in California I am assuming the recording was made there. California is one of eleven states that require two party consent therefore his permission was needed. I have not really paid too much attention to the details but I understand that, according to the reports, he was aware that he was being recorded.
