Per NEC, NOT in a commercial, public or rental property. I have been though this many times and I am 100% sure of this.
Now if some local yocals don't adopt NEC requirements then anything goes but the code is clear.
Can you point out the specific section of the NEC where it states that new sections of the code must be enforced on previously legal wiring? I personally have never run across that section. I realize you are 100% sure but I need to reference a NEC section and can't find it.
