I believe the Idaho Tote does pivot at the attachment to the trailer.
As far as I can determine all of the swivel wheels pivot at the trailer attachment. Cruiserlift even calls their swivelwheel a trailer.
Smart Trailers also refer to their swivel wheel type as trailers and make no claims about them being legal in states that don't allow double towing. They do recommend that you find out for yourself if they are legal in your state.
Per my other post, I think the "pivot" referred to in the letter was a side-to-side pivot and not a vertical pivot.
