I consider myself to be quite defensive when it comes to driving, always watching out, looking at other vehicles, preparing for any bonehead thing they may do.... But you know, sometimes some clown...

My interpretation was that it was a sarcastic, smart-alek (and sympathetic) remark on a lot of today's legal insanity:
He hit the drunk with is giant, politically-incorrect, gas-guzzling, climate-killing dually...he should have been driving a Prius knowing that a drunk might pull out in front of him and needing to be hit less hard...therefore, he should pay. Call the lawyer on the TV commercials/billboards.
