Who has an 'answering machine?' Doesn't your provider have vm? If you don't want calls at 2am, turn OFF the ringer!

Yes, the DNC list is a joke. That's why cell phones are so handy in that you can easily block calls. AS for the OP, apparently that's not availalble. All cell phones are on the DNC, but it's not bullet-proof.
