At the minimum, the driver should have stopped, because it is the law to heed warning signs, even though the trucking company should have been wiser about overheight loads.
In the Army, when doing a wreck analysis, they will ask the driver, "if you were going 1 mile an hour, could this have been avoided?" If the question is anything but a definite no, the driver is faulted.
