Apple has a patent for the technology that locks out a phone while driving. Don't know if it can tell who's using a phone in a car but that is a good point. Couple of articles

here that may or may not have some background on how it works. Someone actually filed a lawsuit last year against Apple for not implementing the technology they patented. Between gov't, insurers, automakers, drivers and phone makers, it's a complicated issue.
