Defending oneself while being actively attacked is NOT an "offensive" action. What should the victim have done- bend over and attempt to reason with the (unattended) animal, thereby offering his FACE for a target?
And while we're on the "good grief" subject (gross exaggeration department):
Do please show us where it says "3-4 pound Chihuahua" in the witness statement below.

The kicker just kept walking as if nothing happen and after a few minutes the dog owner may of noticed the dog wasn't barking and went looking for him.
Until we left a few days later, the dog spent most of his day silently on the owner's lap..
I considered telling the Dog's owners what had happened, but didn't.
