Defending oneself while being actively attacked is NOT an "offensive" action. What should the victim have done- bend over and attempt to reason with the (unattended) animal, thereby offering his FACE for a target?
And while we're on the "good grief" subject (gross exaggeration department):
Do please show us where it says "3-4 pound Chihuahua" in the witness statement below.

A couple of weeks ago camped across from one of those little yippie ankle biting dogs. Owner never had him on a lease, even though it was clearly posted on the sign in rules board, that all dogs must be on a 6 foot lease.
The dog would ambush and yip and bite everyone that walk on the road pass his territory.
One guy must had enough of the dog's yipping and biting, as the dog was biting at his ankle he quickly turned around and football style, field kicked the dog into the air.
The dog may of received some internal injuries???
The kicker just kept walking as if nothing happen and after a few minutes the dog owner may of noticed the dog wasn't barking and went looking for him.
Until we left a few days later, the dog spent most of his day silently on the owner's lap..
I considered telling the Dog's owners what had happened, but didn't.
