Well, that depends on how deep you search and what your reasons are. I know of several cases where people have been fired for doing such things as running a Criminal History check on someone when NO CRIME was being investigated.
But then. I was in the criminal history business (It was part of my job to run them when authorized) and thus I was told when someone ran one when they should not. That way. I would be less likely to do so.
The article mentioned 700 pages of CONFIDENTIAL information. Also, people use the words "background check" synonymously. There's a driving record check, there's a check through NCIC (National Crime Information Center), there's background checks through the FBI that include fingerprints and etc. they said he was using a dept of justice computer which tells me it's probably NCIC. And yes it's a big no no for anything other than official use. There is so much paperwork that needs to be completed and maintained. Checks have to be logged. You can and will be audited at any time. If there are any discrepancies, you can lose the terminal and access from it.
The NSA does not have to do background checks. They have all the info they need. If they do feel the need to go through NCIC for anything, then there is a security reason for them doing so. If they are doing it to their girlfriends, then that is a violation. Do they do it? I'm sure. The thing is if they get caught. - AtleeExplorer IIFree, maybe. Someone is paying their salaries. Legally? I'd say the jury is still out on what was and was not legal.

When our Forefathers wrote the Constitution it was to spell out what powers the Government was given. government exist to serve Americans and maintain the Republic. Who ever is elected is not granted any permission to abrigate the Constitution or do any thing else he or his group imagines. Not one thing.
They have no permission to pry into anyone's lives. To run a background check they need permission from a Court and a good reason to present to that Court.
They are not following the Law. Any law they contrived or reinterpreted to do otherwise is illegal. We don't have Dictators and Tyrants.
Anyone that enforces such things is not a friend to the People nor serving the Republic. It is treachery and tyranny and treason.
