If the tree is in the "tree box", the area between the sidewalk in the curb, it belongs to the municipality. I have a fifty year old one in front of my house and the country refuses to cut it down despite the fact that its roots heaved up my driveway and their sidewalk. I replaced my driveway and the county comes around and cements over the heaved edges of the sidewalk.
Their tree is starting to mysteriously disappear, one branch at a time. It looks like a celery stalk now. Hopefully when I call them to tell them their tree is dead, they will do something.
