Op here. I'm not going to pursue anything. It' s a rub mark on awning from a tree, but still if the clearance is not what it should be by the city own standards it makes me angry. It will cost more to pursue than what I'd get.
To the guy that brought up Pre-trip inspection HA HA when was the last time you saw a sign that said 13'6" and stopped and measured to confirm the measurement was actually right before going thru it? Once again here is there own law they made:
ORDINANCE NO. 2012 - 04
AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE
STATE OF IDAHO; PROVIDING FOR THE AMENDMENT OF MOSCOW CITY CODE
TITLE 5, CHAPTER 14, SECTION 3 TO REQUIRE THAT OBJECTS THAT OVERHANG
THE STREET MUST PROVIDE A MINIMUM OF TWELVE FEET (12') VERTICAL
CLEARANCE; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE
DEEMED SEVERABLE; AND PROVIDING FOR THIS ORDINANCE TO BE IN FULL
FORCE AND EFFECT MAY 1, 2012, AND FOLLOWING PUBLICATION ACCORDING TO
LAW.
WHEREAS, the City desires to promote the use of and maintenance of tree lawns m an aesthetically pleasing and safe way; and
WHEREAS, occasionally property owners adjacent to public rights-of-way wish to place objects within the tree lawn; and
WHEREAS, the public rights-of-way should be kept free of obstructions and other objects that make it difficult to provide maintenance, snow removal, street sweeping, and other street and tight-of-way maintenance and repair services; and
WHEREAS, the Community Forestry Ordinance requires branches of trees that overhang streets to be pruned to provide a minimum of twelve feet (12') of vertical clearance; and
WHEREAS, such twelve feet (12') of vertical clearance allows sufficient clearance to move on
and through the right-of-way with safety; and
WHEREAS, the Council believes that it is in the best interest of the City and its citizens to
require the removal of objects in tree lawns that overhang streets and highways and provide less
than twelve feet (12') of vertical clearance within them;
