I understand that the axle and RV company would prefer to give you the runaround. In my opinion the warranty excuse would apply if this was considered normal wear but unless they can point to documentation that informs you that you can expect the frame to fail after xx miles it sounds like a design defect to me.
When you have the repairs done keep every bit of paper on the costs and print out any email reply from Lippert. Record date, time and who you talked to at Lippert or RV company and what they said and take pictures of the problem before and after the repair.
You might even call them back if you don't have records. Ask for the name of a weld shop or RV dealer they suggest to do the repair. Be sure the pictures are well lit and in focus. Do you have a friend into photography with a good DSLR? iPhone camera is not the quality you will need.
NHTSA will want the VIN from the trailer and if you have axle P/N that is good too.
Your single complaint will not generate enough interest but if there are a number of complaints with offers to provide photos of the tire failure caused by the axle problem there may be action forced on Lippert. If that happens there is a possibility of filing for a refund but you would need to be able to prove your claim is valid. No documents no payment.
There have already been complaints with the NHTSA. If you look at the link I provided it came from their website. It is a design defect which is why they go into detail on that lip sheet about how to weld in more bracing and support. The guy at Lippert made a comment and said "how do we know you didn't seriously overload the trailer then drive it down some bumpy dirt road causing the frame to distort and cause cracks". That's when I told him he was wasting my time and to transfer me to the parts department. If you google Lippert you'll find all sorts of complaints about the frames. I plan to document everything before, during and after the repair.
On a different note anybody got an opinion on new spring sizes? I'm looking to go with something more beefier. The springs I got now are 2200# and I was thinking about going to a 2400# or 2800# spring. Im not looking for extra capacity just something to handle the weight better
