Oh, and, If you didn't know, a open box of beer is considered a open bottle in many states. Even if your not drinking and there is no actual open can of beer. I have heard things are different in Texas and just wanted to let you know this.
I heard that, and I think it was MN, where a can pulled out of the 6 pack plastic ring was considered an open container. would be interested in seeing actual case law/etc. on that.

I've heard the open 6 pack thing is a law too and I believe it. But, I've never seen it. I do know people personally that have gotten open bottle tickets for a open 12 pack and they weren't drinking at the time of the ticket.
Oh, and don't forget, everyone in the car gets a ticket!! Not just the vehicle driver . Not to mention once the open container is spotted the car and the people in it will be searched. Anything illegal in it or on anyone is a ticket for everyone in the vehicle. I'm very, very, careful about getting into vehicles with other people unless I know them very, very, well.
Technically, the law states any open alcohol container is against the law. It doesn't have to have alcohol in it. I don't personally know of anyone getting in trouble for that. But, if your driving around in a car with empty open alcohol containers and you get pulled over it's going to look darned suspicious.
Remember I live in a very rural area. The best way to keep the cops happy is not to be seen driving around with anything suspicious. If you don't give them any reason to look at you then you will have a better reputation and then your life will be better. I didn't explain that very well so I hope you understand what I'm trying to say.
