I'm not sure about the illegal part. There are some US Coast Guard regulations.
In regular use, explosive gas is emitted from flooded batteries, plus corrosive sulphuric mist. No one will dispute that, if installed in a living space, it is 'proper' as well to put flooded batteries in a sealed container with a vent to the outside.
AGMs are sealed and do not emit either hazard in regular use. Many people install them inside the living space without the venting.
