Since you seem to make a big issue out of this, I invite you to check Chapter 3 Art 300-3 of the NEC.
To cite it partially:
"No wiring systems of any type shall be installed in ducts. . .no wiring systems of any type shall be installed in any duct, or shaft containing only such ducts, used for vapor removal or for ventilation. . . ."
Now, if you have a better argument, I'm all ears.
